IMPORTANT NOTICE. Apex BioSciences makes its products available exclusively to licensed healthcare practitioners and verified prescribers, for use within their professional practice and clinical judgment. Products are not sold direct-to-consumer. Certain products are compounded preparations prepared by FDA-registered 503A/503B outsourcing facilities; as compounded preparations, they are not FDA-approved. Practitioners are responsible for appropriate patient selection, informed consent, and compliance with all laws governing their practice.
1. Agreement to Terms. By accessing or using the Apex BioSciences website and services operated by [Legal Entity, LLC] (“Apex BioSciences,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Eligibility & NPI Verification. Our products and services are available only to (a) individuals of legal age in their jurisdiction; (b) licensed healthcare practitioners holding an active, unrestricted professional license and a valid National Provider Identifier (NPI); and (c) approved practitioner accounts in good standing. We verify the NPI you provide against the NPPES registry at sign-up and may further verify professional licensure. We may refuse or revoke access to anyone, at any time, at our discretion.
3. Practitioner Accounts. To purchase, you must register and be approved as a practitioner, including providing a valid NPI. You agree to provide accurate, complete registration information, safeguard your credentials, keep your information current, and accept responsibility for all activity under your account.
4. Products & Professional Use. Products are made available solely to licensed practitioners for use within their professional practice. They may not be resold to consumers, repackaged for resale, or diverted. Certain products are compounded preparations from FDA-registered 503A/503B partners and are dispensed or administered under the practitioner's authority and judgment. We may modify or discontinue products, limit quantities, and refuse, cancel, or change the price of any order without prior notice.
5. Orders & Payment. By placing an order you represent that you are an authorized provider with a valid account, that all payment information is accurate, and that you are authorized to use the payment method. All orders are subject to acceptance, verification of licensure, and availability, and may be declined or cancelled at our discretion.
6. Shipping & Delivery. Shipping times are estimates only. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control. Title and risk of loss pass to you upon delivery of the products to the carrier.
7. Returns & Refunds. Due to the nature of the products, returns are accepted only for products that are damaged or defective (reported within 48 hours of delivery) or for orders shipped in error by us. Contact [orders@apexbio.com] to initiate a return.
8. Clinical Responsibility & Assumption of Risk. As a licensed practitioner, you are solely responsible for the appropriate clinical use of the products — including patient selection, dosing, informed consent, recordkeeping, and storage and handling — in accordance with all applicable laws and the standard of care. You assume all responsibility and liability for use within your practice and will not resell or divert the products.
9. Intellectual Property. All content on this website, including text, graphics, logos, and images, is the property of Apex BioSciences and is protected by applicable intellectual-property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Disclaimer of Warranties. THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, APEX BIOSCIENCES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.
12. Indemnification. You agree to indemnify and hold harmless Apex BioSciences and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the services, your handling or use of the products, or your violation of these Terms.

Effective June 2026. How Apex BioSciences, operated by [Legal Entity, LLC], collects, uses, and protects information when you create a practitioner account or place an order.
Information We Collect. Information you provide directly, including: contact details (name, email, phone, practice address); professional-credential information (NPI, license details, taxonomy) used to verify eligibility; account credentials and preferences; order information (billing/shipping details, payment information processed by our payment provider, and order history); and communications you send us. We also automatically collect device/browser information, IP address, pages visited, and cookies or similar technologies.
How We Use Information. To verify practitioner eligibility (including NPI verification via the NPPES registry), process and fulfill orders, manage your account and provide support, send transactional and (with consent) marketing communications, improve our services, detect and prevent fraud, and comply with legal obligations.
NPI & Verification Data. The NPI you provide is checked against the public NPPES NPI Registry to confirm an active provider record. The NPPES registry is public data published by CMS; we use it only to confirm eligibility and to associate your account with your verified professional identity.
Information Sharing. We may share information with service providers who help operate our business (payment processors, shipping carriers, our fulfillment vendor, analytics and marketing platforms); with business partners for advertising and analytics; and where required by law or to protect our rights. We do not sell practitioner credential data.
Your Privacy Rights. Depending on your location, you may have the right to access, correct, or delete your personal information, opt out of sale/sharing or targeted advertising, and withdraw consent for marketing. Contact us to exercise these rights.
Data Retention. We retain personal information for as long as necessary to fulfill the purposes described here, unless a longer period is required by law.
